Power Cool Limited Warranty

Power Cool Systems, Inc. warrants its aftermarket radiators to be free of defects in materials and workmanship for a period of one (1) calendar year from the date of shipment to the original consumer purchaser. This warranty covers any parts furnished from Power Cool Systems, Inc.’s factory, BUT DOES NOT INCLUDE LABOR OR ANY KIND AND MATERIAL NO FURNISHED BY POWER COOL SYSTEMS, INC. OR ANY CHARGES FOR ANY SUCH LABOR OR MATERIALS.
This limited warranty is void if the product is subjected to misuse, negligence, or operating conditions other than those for which such equipment was designed, or has been repaired or altered outside the factory of Power Cool Systems, Inc. or when chemicals or any ingredients other than approved permanent-type antifreeze/coolant, designed solely for radiator use, are used in the radiator. This warranty does not cover the physical or chemical effects of any corrosive substance in the operating environment or the equipment, or has components attached such as fans or condensers by ties or similar fasteners that run through the radiator core, or if the radiator has been used in a racing application. This warranty is only extended to and enforceable by only this original consumer purchaser.
POWER COOL SYSTEMS, INC.’S WARRANTY OF ITS PRODUCTS TO BE FREE FROM ALL DEFECTS IN MATERIAL AND WORKMANSHIP, AS LIMITED HEREIN, AND SHALL BE IN LIEU OR AND EXCLUSIVE OF ALL OTHER WARRANTIES WHETHER EXPRESS OR IMPLIED, INCLUDINT WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
Claims for internal engine damage due to overheating will be denied. All vehicles and stationary equipment have warning lights and gauges to warn an operator of overheating conditions long before internal engine damage would occur. Power Cool Systems, Inc. shall not be responsible for engine damage due to operator negligence.
If the radiator fails due to a defect in material or workmanship, the original purchaser shall be responsible for presenting the defective radiator and A COPY OF THE ORIGINAL PURCHASE RECEIPT to the place of original purchase with all transportation expenses prepaid by purchaser, and which the examination by Power Cool Systems, Inc., or its designated agent, shall disclose to have been defective to verify the cause of the radiator failure. RETAIN YOUR ORIGINAL RECEIPT for future proof of purchase. Freight for approved defective merchandise returns submitted for warranty will be paid by Power Cool Systems, Inc. on a reimbursement basis. Good returns MUST be returned freight prepaid. All risk of loss or damage are retained by the customer while the goods are in the possession of the freight carrier en route to the participating facility. Repair or replacement of the radiator at our sole discretion shall be the SOLE AND EXCLUSIVE REMEDY to which Power Cool Systems, Inc. and its affiliated companies is obligated, and to which the original retail purchaser is entitled. Purchaser’s remedy does not include reimbursement for any expenses incurred for labor or material charges incident to the replacement, removal, or installation of any radiator, radiator core, or component part, towing charges, rental of replacement vehicle, injuries to persons or property and other special, incidental, consequential or punitive damages. An original purchase receipt is required to file a warranty claim.
POWER COOL SYSTEMS, INC. AND ITS AFFILIATED COMPANIES IN NO EVENT SHALL BE LIABLE TO THE PURCHASER FOR DIRECT, INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES OR LOSS OF PRODUCTIONS OR LOSS OF PROFITS OR CLAIMS OF THIRD PARTIES AGAINST THE PURCHASER, RESULTING FROM ANY CAUSE WHATSOEVER, INCLUDING THOSE RESULTING FROM THE ORDER OF USE OF POWER COOL SYSTEMS, INC.’S PRODUCTS, AND POWER COOL SYSTEMS, INC. SOLE LIABILITY TO THE PURCHASER FOR ANY CAUSE OF ACTION, WHETHER BASED UPON NEGLIGENCE, CONTRACT, OR STRICT LIABILITY, SHALL BE THE REPAIR OR REPLACEMENT REMEDY SET FORTH IN THE PRECEDING PARAGRAPH.
Radiators received which are damaged in shipping should immediately be reported to the shipping carrier as damaged and claims of damage filed accordingly. Contact the transport carrier for procedures in filing a damage claim with the carrier or their agent. Power Cool Systems, Inc. will not accept product returned for damages caused in shipping.
This warranty gives you specific legal rights, and you may also have other rights, which vary from state to state. Power Cool Systems, Inc. neither assumes nor authorizes any person to assume for it any obligation or liability other than as herein expressly stated.
